Lease Agreement Addendum For Smoke-Free Areas THIS AGREEMENT made and entered into between _______________________, Owner/Agent" and ________________________________, Resident. SMOKE-FREE POLICY: Due to the increased risk of fire and the known health effects of secondhand smoke, Smoking is prohibited in any area of the property or except in the following area: 1. 2. The policy applies to all owners, tenants, guests, and servicepersons. Smoking: Includes inhaling, exhaling, carrying any lighted cigar, cigarette or other tobacco product. 1. No Smoking Rules: The parties agree to eliminate all cigarettes, cigar smoking and all tobacco products in the rental unit and in all common areas of the building and any adjoining grounds to the building located at: (address)_____________________________________________________________________ 2. Tenant Obligations: Resident(s) agree to inform all guests of the no smoking policy. Resident(s) agree to notify the owner/manager of any violations by guests of no smoking or any house rules as they occur. All parties acknowledge that the owner/manager cannot guarantee a smoke free environment, but agrees to make reasonable attempts to enforce this addendum when given prompt written notice. Residents are asked to police themselves and all guests. 3. A breach of this agreement: A breach of this Addendum by the Resident shall be deemed a material breach of the Lease/Rental Agreement and grounds for immediate termination. 4. Disclaimer: Owner/Agent specifically disclaims any implied or express warranties that the building common areas or Resident's premises will have improved air quality. Owner/Managers ability to monitor or enforce this addendum is dependent on voluntary compliance by Resident and Residents guests. 5. To current Residents of_________________________________________ Current resident under an existing lease arrangement will not be subject to the new non smoking provisions. As new residents move into _______________________________________they will become subject to the terms of this nonsmoking addendum.
