Lead Paint Federal Disclosure Laws
Federal Law requires lead paint disclosure to all residents for Housing
Built Prior to 1978. Lead paint can severely damage infants and adults.
All building built before 1978 are assumed to be exposed to lead in
paint and its potential dangers.
Part of the move in packet for new tenants should include the lead
pamphlet which can be found on this site. It is the obligation of the
owner/manager to provide this information to all tenants if your
building was build before 1978.
You should review your insurance policy to see if it covers any
suits due to exposure to lead or to the mishandling of the law
regarding proper lead paint disclosure.
What You Need To Know
- A disclosure form
must also be completed by the owner/agent, and the tenant must sign the
form acknowledging receipt of the booklet and the information.
- Keep the file for at least three years. Many advisors suggest that all
records be kept for seven years. Check with your advisor or apartment
association
- Include in your files any records that disclose the location of lead based paint.
Consider having the pamphlet
available to all tenants when remodeling or painting or anytime
original paint may be disturbed. Use our lead paint receipt to document
your obligation to notify.
